We have already been discussing the costs of the debt collection in the text: Known debt collection costs. It is a standard on the Polish market to charge remuneration on the success fee basis, i.e. solely on the recovered amounts. Nevertheless, a lot of entrepreneurs still do not know it. The conviction about high costs of these services results in the fact that companies often limit themselves to their own amicable debt collection attempts which often fail to bring the expected result. If the debtor ignores your phone calls and e-mails with reminder about the payment, misleads you all the time and you struggle with the effects of payment jams, you should know that while ordering professional debt collection, you may recover also its costs from the debtor.
On the basis of the Act on Payment Terms, for almost a year the creditor may demand the equivalent of the amount of EUR 40.00 as lump-sum debt collection costs, regardless of the scope of taken actions and the amount of the claim. They may also transfer the costs of pursuing of the claim exceeding this amount, including e.g. the commission of the debt collection company, to the debtor. It means that apart from the debt itself, the debt collection company may recover the entire debt collection costs for us.
Nevertheless, it must be remembered that these costs have to be actually incurred. They cannot be demanded in advance but solely after presentation of the proof of their payment. Professional debt collection companies have introduced the recovery of their own commission from the debtor to their offer. Such arrangement results in comfort of entrusting of debt collection to a professional company for the creditors. The probability of effective debt collection increases enormously and moreover, it is not connected with any costs.
We should only return the invoice issued for the realised service by the debt collection company to it and it will request the debtor on our behalf to return the debt collection costs. So if you have been prevented from ordering of the debt collection by the conviction about high price of these services, now this argument has lost its legitimacy. In the context of these facilities, it is worth verifying your attitude towards handling of the non-timely paid receivables.
